If the second Balliol is actually a distinct, separate entity at this point - with his own whatever-passes-for-a-body when one is a psionic entity - then he would be tried separately. If it's just a split personality within the same person, then they are tried as one being, because they *are* one being.
I have heard much of this esper theory, which is where a great deal of this confusion is coming from. But, that is what trials are for: to ascertain the truth.

This is the duty of the guard to uphold the law within the barony, please allow them to perform it. Tensions are running high. This is a very decisive battle and I would rather see we all show the hand of compassion to one another. We needn't encourage aggressive action.
